Seth A. Katz

Mr. Katz joined Burg Simpson in September 2005 after six years with the New York law firm of Seeger Weiss LLP, in which he was a partner. Mr. Katz focuses his practice primarily in the areas of complex, pharmaceutical mass tort, and class action litigation including consumer protection, securities fraud, products liability, and commercial litigation. In addition to his varied professional experience, Mr. Katz is a frequent speaker on electronic discovery, class actions, and pharmaceutical litigation. In August 2014, Mr. Katz was appointed to the Plaintiffs’ Executive Committee in In re: Testosterone Replacement Therapy Products Liability Litigation (MDL 2524) by the Hon. Matthew F. Kennelly, which is pending in the Northern District of Illinois. In that MDL, he also serves as the Co-Chair of the Discovery Committee overseeing the discovery against 5 manufacturers of six different products involved in that MDL. In September 2012, Mr. Katz was appointed as Co-Lead Counsel in the In re Pradaxa (Dabigatran Etexilate) Products Liability Litigation (MDL 2385) by the Hon. David R. Herndon (Chief Judge of the United States District Court for the Southern District of Illinois). In May 2014, the Pradaxa MDL announced a $650 million settlement program on behalf of approximately 4,000 claimants after 21 months of litigation. Mr. Katz was one of the primary negotiators of that settlement and as Co-Lead Counsel in the MDL played an active role in the administration of the settlement, including the resolution of private and government medical liens. In January 2011, Mr. Katz was appointed to the Plaintiffs’ Steering Committee in the In re DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation (MDL 2197) by the Hon. David A. Katz, in the Northern District of Ohio. Mr. Katz was one of the primary attorneys who prosecuted the In re Zyprexa Products Liability Litigation (MDL No. 1956) that resulted in a $700 million settlement, where he not only held a leadership role in conducting discovery but he also served as chair of the law and briefing committee. A class settlement was reached and approved by the District Court in 2013 and was implemented in 2016 after appeal by an objector. During his time at Seeger Weiss, Mr. Katz and Seeger Weiss also served as lead counsel in Manavazian v. ATEC Group, Inc., a securities fraud class action, which resulted in a significant settlement for the class, as well as serving as counsel in several other consumer fraud cases against some of the nation’s largest companies such as Apple, IBM, Firestone Tires, Progressive Insurance Company, Allstate, State Farm, and Panasonic.
