There were obvious problems with liability but Mark was still able to negotiate a satisfactory settlement by emphasising the problems the Plaintiff had with respect to some aspects of its claim and its failure to mitigate.Acting for a valuer in successfully defending a large claim by a bank. Following the disclosure process, Mark had the matter referred to mediation where the claim was settled.Defence of claims arising from use of Filshie Clips brought against Queensland public hospitals following failed tubal ligation procedures alleging inappropriate application of Filshie clips and/or failure to provide any or any proper warnings as to the success or otherwise involving the application of Filshie clips.Between 1999 and 2002, Mark was an in-house legal advisor for Queensland Department of Health. Mark was intimately involved in the consultation and development of the Queensland Health Indemnity Policy for both employed and Visiting Medical Officers. He also provided general legal advice to the Director-General and Health Minister.
