About Kyle
Kyle McFarlane, co-founding partner of BAM, started the firm after gaining experience working for both government and private entities. From an early age, Kyle began preparing herself for a career in family law, earning a bachelor’s degree in Sociology and Psychology from the University of Denver in 2009.While still attending the University of Denver Sturm College of Law, Kyle worked for the Arapahoe County Public Defender’s Office assisting with misdemeanor criminal defense trials. She also worked at the Denver District Attorney’s Office, where she was as an intern in 2013 for the Economic Crimes Unit. Kyle researched and briefed Fourth Amendment, governmental immunity and evidentiary issues for a motion to suppress on a complex murder trial. She wrote several other motions and helped prepare a complex securities fraud case for trial, reading hundreds of pages of grand jury transcripts.She also worked on the Colorado attorney general’s Justice Review Project, which used DNA evidence to exonerate inmates wrongfully convicted. She reviewed approximately 300 applications, including appellate files, news articles and DataAccess, from Colorado inmates incarcerated for violent crimes.She drafted memoranda to supervisors on each case, explaining rational for exclusion or inclusion, and she researched complicity theories, witness credibility issues, and testing of physical evidence in effort to determine whether the case warranted DNA testing.As part of her work with the Justice Review Project, Kyle studied laws in 27 states that offered compensation to wrongfully incarcerated prisoners, and she made an oral presentation of her findings to the Colorado deputy attorney general as part of a proposal for similar legislation in Colorado, which has since been passed and known as Dewey’s Bill.At the University of Denver, where she earned her law degree in 2013, Kyle worked in the Criminal Defense Clinic and became proficient in Rules of Evidence that she continues to use in her family law litigation practice.At the defense clinic, Kyle researched and wrote a variety of motions, including suppression, dismissal, and discovery. She also tried a third-degree assault case resulting in a not guilty verdict and a theft case in which she successfully argued for a mistrial. She argued motions in county court and municipal court, and sheinterviewed clients and witnesses in preparation for hearings and trials and argued in two sentencing hearings.Kyle was selected as a member of the National Trial Team for her courtroom skills and she competed across the country in various mock trial competitions. She was a member of the Moot Court Board, the Student Trial Lawyers Association, and the Trial Advocacy Board, and she taught mock trial skills to high school students.Kyle also had a rare opportunity to take a course and study under Colorado Supreme Court Chief Justice Nancy Rice. In that class, Kyle became well versed in motions practice and learned to put her courtroom litigation schools to use in the form of writing.After graduating from law school, Kyle, worked as an associate attorney in family law for Gutterman Griffiths PC, of Littleton, Colo. She specialized in high asset and high conflict divorce cases, including several high asset and high conflict Aspen cases, and she also successfully litigated an international child abduction case that resulted in the safe return of the child after having been abducted for months.Currently, Kyle is an adjunct professor for the National Trial Team at the University of Denver Sturm College of Law, and she coached the winning team of the Hoffman Tournament there. She also coached the National Trial Team at the fall Buffalo-Niagara Trial Advocacy Tournament, where one of the students was named as the Best Advocate.Kyle’s professional expertise has been recognized by legal and business publications and organizations in Colorado and nationally.While she maintains an Avvo rating of 9.7 “Superb,” Kyle has also been named to the Colorado Rising Stars® list every year since 2017. Rising Stars recognizes the state’s top 2.5 percent of up-and-coming attorneys.In 2018 Kyle was one of only seven Colorado attorneys named an Up & Coming Lawyer by Law Week Colorado.
